What happened

Tenants applied for an order determining that the Landlord gave an N12 notice of termination in bad faith. The Tenants moved out of the rental unit on November 2, 2019 after being served with the N12 notice with a termination date of November 1, 2019. The Tenants alleged that the Landlord provided different reasons for wanting them to vacate and later re-rented the unit.

The ruling

The Tenants' application is dismissed. The Landlord did not give the N12 notice in bad faith, as she had a genuine intention to move into the unit when the notice was served.
