What happened
Tenants applied for an order determining that Landlords failed to meet their maintenance obligations under the Residential Tenancies Act, 2006. The Tenants alleged various maintenance issues with the rental unit, including basement stairs needing repair, cracked/broken windows, a freezer left by previous tenant, loose handrails, roof shingles falling off, drywall not secured, and basement leaks.
The ruling
The Landlords breached their maintenance obligations under the Act by failing to address the various maintenance issues in a reasonable manner. The Tenancy is terminated as of August 1, 2020 and the Landlords must pay the Tenants $1,448, which includes the return of August 2020 rent and the application filing cost.
