What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after the Tenants failed to meet a condition specified in a previous mediated settlement. The Tenants had difficulty making scheduled payments under the previous agreement due to one Tenant being imprisoned, but have since made a $1,000 payment to demonstrate good faith.

The ruling

Order SWL-38807-19, issued on December 4, 2019, is set aside. The Tenants owe the Landlord $3,140.00 for the period ending September 30, 2020, and shall pay this amount according to a payment plan of $300 per month from October 2020 to August 2021, with a final payment of $140 on September 1, 2021. If the Tenants fail to make any of the payments, the Landlord may apply under section 78 of the Act to terminate the tenancy and evict the Tenants.
