What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective January 16, 2022. The tenant must pay the landlord $9,802.22, which represents the rent arrears up to January 5, 2022, plus $186 for the application filing fee. The tenant must also pay $28.92 per day for compensation for use of the unit starting January 6, 2022 until the tenant moves out. If the full amount is not paid by January 16, 2022, the tenant will owe interest at 2% annually on the outstanding balance starting January 17, 2022. If the unit is not vacated by January 16, 2022, the landlord may file the order with the Court Enforcement Office for enforcement. If the tenant pays $10,714.24 by January 16, 2022, the eviction order will be void and the tenancy will continue.
