What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant had not paid rent from May 15, 2021 to November 14, 2021. The Landlord served a Notice of Termination effective July 9, 2021. The Tenant did not dispute the arrears but requested a brief extension to vacate the unit.

The ruling

The tenancy is terminated effective February 8, 2022, unless the Tenant voids the order by paying $58,586.00 to the Landlord or Board in trust by that date. The Tenant is ordered to pay $35,000.00 to the Landlord, representing rent owing and compensation up to January 28, 2022, less the rent deposit. Additional compensation of $240.00 per day is due from January 29, 2022, until the Tenant moves out. The Tenant must also pay $186.00 for the application filing fee.
