What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. The Landlord has also applied for an order requiring the Tenants to compensate the Landlord for damage to the rental unit. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.

The ruling

The tenancy between the Landlord and the Tenants is terminated as of July 31, 2020. The Tenants must move out of the rental unit on or before May 10, 2021. The Tenants shall pay the Landlord $7,602.40, which represents compensation for the use of the unit from August 1, 2020 to April 29, 2021. The Tenants shall also pay the Landlord $27.95 per day for compensation for the use of the unit from April 30, 2021 to the date they move out of the unit. If the Tenants do not pay the full amount owing by May 10, 2021, they will start to owe interest at 2.00% annually on the balance outstanding.
