What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after the Tenant did not pay the rent owed for the period from June 1, 2020 to June 30, 2020.
The ruling
The Tribunal found that it would not be unfair to grant relief from eviction pursuant to subsection 83(1) of the Act, as the amount of rent arrears is small and the Landlord did not attempt to negotiate a repayment agreement with the Tenant. The Tenant is ordered to pay the Landlord $80.00 in rent arrears and $175.00 for the cost of filing the application. If the Tenant does not pay the full amount by January 24, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding.
