What happened

Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the Landlord's lawful rights, privileges and interests by repeatedly refusing the Landlord entry to the rental unit to investigate the Tenant's complaints about toxic fumes and gas.

The ruling

The Landlord's application to evict the Tenant is denied, subject to the condition that for 12 months starting September 1, 2021, the Tenant shall allow the Landlord entry to the rental unit when given proper notice. If the Tenant fails to comply, the Landlord may apply for an ex-parte eviction order. The Tenant shall pay the Landlord $186 for the cost of filing the application.
