What happened

Tenants applied for an order determining that Landlords gave a notice of termination in bad faith. The Tenants moved out of the rental unit on October 31, 2017 after the Landlords served a notice of termination claiming they required possession for the Landlord's child. The Tenants presented evidence that the rental unit was advertised for rent shortly after they vacated, and the Landlord's son did not move into the unit within a reasonable time.

The ruling

The Landlords are ordered to pay the Tenants $8,700 for the increased rent they incurred for 12 months after vacating the rental unit, and $50 for the cost of filing the application. The total amount the Landlords owe the Tenants is $8,750, which must be paid by July 8, 2018. If the Landlords do not pay by that date, they will owe interest at 3% annually on the outstanding balance.
