What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had not paid the full rent for the period from July 1, 2021 to November 30, 2021.

The ruling

The tenancy is terminated effective December 12, 2021, unless the Tenant pays $3,510.63 to void the eviction order. The Landlord is authorized to offset $66.10 per day for compensation for the Tenant's use of the unit starting December 2, 2021 until the Tenant moves out, and $186 for the application filing fee. The Tenant may make a motion to set aside the order if they pay the required amount on or after December 13, 2021 but before the Sheriff enforces the eviction.
