Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The Tenants owed $106,000 in rent arrears up to July 31, 2021.

The ruling

The tenancy is terminated effective August 1, 2021. The Tenants are ordered to pay the Landlord $35,000, which represents the rent owing to July 21, 2021 and the Landlord's filing fee, less the amount extinguished pursuant to subsection 207(3) of the RTA. If the Tenants do not pay the full amount owing by August 1, 2021, they will owe simple interest calculated from August 2, 2021 at 2.00% annually on the balance outstanding.
