What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. Tenants applied for an order determining that Landlord failed to meet maintenance obligations or comply with health, safety, housing or maintenance standards. Tenants requested to withdraw their application as they are proceeding in Divisional Court, but the request was denied.
The ruling
The tenancy is terminated effective November 5, 2021. The Tenants must pay the Landlord $35,000, which is the Board's monetary jurisdiction. If the Tenants do not pay by November 5, 2021, the Landlord may file the order with the Court Enforcement Office for eviction. The Tenants can void the order by paying $35,000 on or before November 5, 2021.
