What happened

Landlord applied to terminate the tenancy and evict Tenant due to non-payment of rent. Landlord also applied for an order requiring Tenant to pay compensation for damages caused by Tenant or a person Tenant permitted in the residential complex.

The ruling

The tenancy is terminated effective January 31, 2019. The Tenant must vacate the rental unit by that date. The Tenant is ordered to pay the Landlord $4,990 in rent arrears, less the last month's rent deposit, by January 31, 2019. If the Tenant does not pay the full amount by the due date, they will owe interest at 3% annually on the outstanding balance starting February 1, 2019. The Tenant must also pay the Landlord $45.04 per day for use of the unit from February 1, 2019 until they move out. The Landlord's application for damages is withdrawn.
