What happened
Tenant filed an application alleging the Landlord harassed her into moving out of the rental unit. The Landlord repeatedly told the Tenant to move out, even though she had a valid lease, and allowed the purchaser and their representatives to enter the unit without notice. The Landlord also attempted to enter the unit without notice. The Tenant felt she had no choice but to move out due to the Landlord's actions.
The ruling
The Landlord's conduct was found to be in violation of the Residential Tenancies Act, as he failed to follow the proper procedures for evicting the Tenant. The Landlord is ordered to pay the Tenant $7,955, which includes a $5,000 fine to the Board, $3,600 for the increased rent the Tenant has incurred, $100 for moving expenses, and a $4,255 rent abatement for the harassment that substantially interfered with the Tenant's reasonable enjoyment of the rental unit.
