What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Randall Greenhaulgh had moved into the rental unit on February 1, 2019, but the other tenant Kenneth Hryciuk was found to not be in possession of the unit on the application date.
The ruling
The tenancy is terminated effective December 8, 2020. The tenant Randall Greenhaulgh is ordered to pay $7,409.34 to the landlord, which includes rent arrears up to November 27, 2020 and the cost of filing the application, minus the rent deposit and interest on the deposit. The tenant is also ordered to pay $37.81 per day for compensation for use of the unit starting November 28, 2020 until the date the tenant vacates.
