What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective December 20, 2020 unless the Tenants pay $6,195 to void the order. The Tenants must pay the Landlord $3,602.21 for rent arrears and compensation, plus $78.90 per day starting December 8, 2020 until they move out. The Landlord is ordered to ensure the toilet is not leaking and is capable of full use.
