What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and substantial interference with the reasonable enjoyment of the landlord or other tenants. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice) and a Notice to End Tenancy Early for Interfering with Others (N5 Notice), which the tenants did not void.

The ruling

The tenancy is terminated unless the Tenants pay $47,053.06 (less any payments made) by November 27, 2023 to void the order and continue the tenancy. If the Tenants do not pay this amount, they must vacate the unit by November 27, 2023 and pay the Landlord $35,186.00 in rent arrears and application fees. The Tenants must also pay the Landlord $1,448.08 for unpaid utility costs.
