What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the full rent for the period from August 1, 2020 to July 31, 2021.
The ruling
The tenancy is terminated effective July 31, 2021. The Tenants must pay the Landlord $13,012.42, which represents the rent arrears and compensation up to July 20, 2021, plus $52.27 per day for compensation for use of the unit starting July 21, 2021 until the Tenants move out. The Tenants must also pay the $186 application fee. If the Tenants do not pay the full amount by July 31, 2021, they will owe interest starting August 1, 2021. If the unit is not vacated by July 31, 2021, the Landlord can file the order with the Sheriff for enforcement.
