What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. Ammar Sarigat was no longer in possession of the unit at the time the application was filed.

The ruling

The tenancy is terminated effective March 23, 2023 unless the Tenant pays $21,186 to void the order and continue the tenancy. If the Tenant does not pay, they must move out by March 20, 2023 and pay the Landlord $16,932.60 plus daily compensation of $49.32 per day starting January 6, 2023 until the move-out date.
