What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had disconnected from the hearing before it began, and were not present or represented.

The ruling

The tenancy is terminated effective January 23, 2023 unless the Tenants pay $14,186 to void the order and continue the tenancy. If the Tenants do not pay, they must vacate the unit by January 23, 2023 and pay the Landlord $12,970.12, plus daily compensation of $46.03 per day starting January 5, 2023 until they move out.
