What happened

Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served an N12 notice to terminate the tenancy for personal use.

The ruling

The Tenants' application is dismissed. The Landlord served the N12 notice for residential occupation for himself and his family, and the Tenants subsequently vacated the rental unit. The Tenants did not establish the bad faith of the Landlord and did not satisfy the third requirement of section 57(1)(a) of the Act.
