What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant did not attend the hearing despite proper service of notice. The amount of arrears exceeded the Board's monetary jurisdiction of $35,000.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $72,841.00 by February 18, 2023. If not voided, the Tenant must move out by February 18, 2023, and pay the Landlord $35,000.00 (the maximum amount within the Board's jurisdiction). The Tenant shall also pay $134.79 per day for use of the unit from February 1, 2023, until move-out.
