What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Nigel Mullings was still in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective March 1, 2021. The Tenants must pay the Landlord $17,099.08 in rent arrears and compensation, plus $55.89 per day starting February 19, 2021 until they vacate the unit. The Tenants can void the eviction order by paying $17,886 by February 28, 2021 or $19,586 by March 1, 2021.
