What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. Tenants have been paying rent late since May 2019, and currently owe $8,693.24 in arrears. The Landlord entered into a repayment agreement with the Tenants, which has been breached.
The ruling
The tenancy is terminated effective January 21, 2022. Tenants must pay $20,053.71 for use of the unit from February 1, 2021 to January 10, 2022, plus $63.50 per day from January 11, 2022 until they move out. They must also pay $201.00 for the application filing fee. If not paid by January 21, 2022, interest will accrue at 2.00% annually. The Landlord may file for eviction enforcement starting January 22, 2022 if the unit is not vacated.
