What happened
Landlord applied to terminate the tenancy and evict the Tenant due to wilful or negligent damage to the premises, and serious impairment to safety. The issues arose from a break-in to the garage related to the rental unit, which caused damage and created a safety hazard.
The ruling
The tenancy is terminated effective October 30, 2021. The Tenant must pay the Landlord $423.88 for the cost of repairing the damage, $186 for the application fee, and $26.30 per day for use of the unit after October 30, 2021 if the Tenant does not vacate by that date. If the Tenant does not pay the full amount by October 30, 2021, interest will accrue at 2% annually on the outstanding balance.
