What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant makes the following payments to the Landlord: $600.00 by October 1, 2021, $200.00 by November 1, 2021, and $140.38 by December 1, 2021, for a total of $940.38. The Tenant shall also pay the lawful monthly rent in full for August 2021 and September 2021 on or before October 1, 2021, and continue to pay the lawful monthly rent in full and on time on or before the first of the month, commencing October 1, 2021. If the Tenant fails to make any of the payments as required, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing shall become payable with simple interest calculated at 2.00% annually.
