What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to meet a condition specified in a previous order issued by the Board on September 7, 2021. The condition was that the Tenant, any occupants and/or guests shall wear a facemask at all times when in the common areas of the residential complex for as long as this policy exists. The Landlord provided video surveillance footage showing the Tenant's guest entering the residential complex without a facemask on September 7, 2021.
The ruling
The tenancy between the Landlord and the Tenant is terminated. The Tenant must move out of the rental unit on or before October 25, 2021. The Tenant shall pay the Landlord $30.99 per day for compensation for the use of the unit starting October 15, 2021 to the date the Tenant moves out of the unit. If the Tenant does not pay the full amount owing on or before October 25, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding. If the unit is not vacated on or before October 25, 2021, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced.
