What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to meet a condition specified in a mediated settlement issued by the Board on January 22, 2020. The Tenant filed a motion to set aside the ex parte order issued on February 12, 2021.

The ruling

The Tenant's motion to set aside the ex parte order is denied. However, the ex parte order is cancelled and replaced with a conditional order. The Tenant must remove the trailer from the parking area by June 15, 2021 and comply with the parking agreements for the next 12 months. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy.
