What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant was employed as a superintendent and argued she was approved for a leave of absence, so she was not required to pay rent.

The Landlord's application is dismissed. The notice of termination was found to be defective, as the rent period in the N4 notice did not align with the Landlord's own letter approving the Tenant's leave of absence.
