What happened

Landlord applied for an order to terminate the tenancy and evict Tenant for personal use of the rental unit. The original order was issued in Landlord's favor when Tenant did not attend. Tenant requested a review, which was granted with a stay of the original order. At the review hearing, neither party attended, resulting in the review request being considered abandoned.

The ruling

The Landlord and Tenant Board denied the Tenant's request to review the original order due to the Tenant's absence at the review hearing. The original order terminating the tenancy for the Landlord's personal use remains in effect, and the stay of that order is lifted immediately.
