What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit as of the hearing date.
The ruling
The tenancy is terminated effective June 30, 2021. The Tenant must pay the Landlord $4,017.94, which represents the rent arrears and application filing costs, less the rent deposit and interest owed on the deposit. The Tenant must also pay $40.31 per day for compensation for use of the unit from June 11, 2021 until the Tenant vacates. If the Tenant does not pay the full amount by June 21, 2021, the Tenant will owe interest. If the unit is not vacated by June 30, 2021, the Landlord may file the order with the Sheriff for enforcement. The Tenant can void the eviction order by paying $6,316.00 on or before June 30, 2021.
