What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The tenancy is terminated effective July 31, 2021, subject to the Tenant making the following payments: $950 rent for May by May 20, 2021; $300 towards arrears on May 20, 2021; $950 rent for June by June 1, 2021; $300 towards arrears on June 20, 2021; and $300 towards arrears on July 20, 2021. If the Tenant fails to make any of these payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and for any new arrears. The last month's rent deposit and interest will be applied to the July 2021 rent.
