What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served a valid N8 notice for persistent late payment, and the Tenant did not void the notice by paying the arrears. The Tenant was in possession of the rental unit at the time of the application.

The ruling

The tenancy was terminated effective September 20, 2021. The Tenant was ordered to pay $2,157.50 to the Landlord, which included rent arrears, compensation, and the application filing fee, less the rent deposit and interest owed on the deposit. The Tenant was also ordered to pay $47.77 per day in compensation for each day of occupation starting September 1, 2021 until the Tenant vacated the unit. If the Tenant did not pay the full amount owing by September 11, 2021, the Tenant would start owing interest on the balance.
