What happened
Landlords applied for an order to terminate the tenancy and evict Tenant because the Landlords require possession of the rental unit for the purpose of residential occupation. The Landlords' widowed mother intends to move into the basement with her other son, who has a disability, for more privacy.
The ruling
The tenancy is terminated effective November 16, 2021. The Tenant must move out by that date. The Tenant shall pay the Landlords $7,927.30, which represents compensation for the use of the unit from June 1, 2021 to November 5, 2021, less the rent deposit and interest owed on the deposit. The Tenant shall also pay $62.47 per day for compensation for the use of the unit from November 6, 2021 to the move-out date, and $186.00 for the cost of filing the application. If the Tenant does not pay the full amount by November 16, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
