What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the full rent from August 1, 2020 to June 30, 2021.
The ruling
The tenancy was terminated effective August 22, 2021. The Tenants were ordered to pay $2,277.84 to the Landlord, which includes rent arrears up to August 11, 2021 and the cost of filing the application, less the rent deposit. The Tenants were also ordered to pay $31.63 per day for compensation for the use of the unit starting August 12, 2021 until they move out. If the Tenants do not pay the full amount by August 22, 2021, they will start owing interest at 2% annually on the outstanding balance.
