What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the total rent they were required to pay for the period from April 1, 2021 to August 31, 2021.
The ruling
The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant shall make the following payments to the Landlord in respect of the monies owing: $400.00 on the 15th of each month from December 2021 to August 2022, and a final payment of $396.00 on September 15, 2022. The Tenant shall also pay the Landlord the rent for the months of December 2021 up to and including September 2022, in full, on or before the first day of each corresponding month.
