What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit by the hearing date.

The ruling

The tenancy is terminated effective August 8, 2021. The tenant shall pay the landlord $52.60, which includes rent arrears up to July 28, 2021 and the landlord's filing fee, less the rent deposit and interest owing on the deposit. The tenant shall also pay the landlord $27.65 per day in compensation for the use of the unit from July 29, 2021 to the date the tenant vacates. If the tenant does not pay the full amount owing by August 8, 2021, he will owe simple interest calculated from August 9, 2021 at 2.00% annually on the balance outstanding.
