What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Landlord also claimed NSF cheque charges and related administration charges.
The ruling
The tenancy is terminated effective September 10, 2021. The Tenant must pay the Landlord $1,156.11, which includes rent arrears, NSF cheque charges, and application filing fees, less the rent deposit and interest owed on the deposit. The Tenant must also pay $44.11 per day for compensation for use of the unit starting August 31, 2021 until the Tenant moves out. If the Tenant does not pay the full amount by September 10, 2021, the Tenant will start owing interest. If the unit is not vacated by September 10, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant can void the order and continue the tenancy by paying $2,688.05 by August 31, 2021 or $4,029.76 by September 10, 2021.
