What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective May 10, 2021, unless the Tenant pays $1,600.85 on or before March 31, 2021, or $3,577.59 on or before May 10, 2021 to void the order and continue the tenancy. The Landlord is authorized to offset $32.49 per day for compensation for the Tenant's use of the unit starting March 11, 2021 until the Tenant moves out, and $186.00 for the cost of filing the application.
