Landlord applied for an order to terminate the tenancy and evict Tenants due to Tenant Richard Walker's behavior substantially interfering with the reasonable enjoyment or lawful rights of the Landlord or another tenant.
The ruling
The Tribunal found that the Tenant Richard Walker's conduct of yelling, swearing, and harassing another tenant substantially interfered with the Landlord or another tenant's reasonable enjoyment. However, the Tribunal decided to provide the Tenant an opportunity to cease the behavior, with failure to do so resulting in the Landlord having the right to evict the Tenants without notice. The Tenants were ordered to pay the Landlord $186 for the cost of filing the application.
