What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The tenancy is terminated effective August 18, 2020. The Tenants must pay the Landlord $10,215.00 (less any amount paid after the hearing) for rent arrears and compensation, plus $53.26 per day for use of the unit from April 1, 2020 until move-out, less the rent deposit and interest owed on the deposit. The Tenants must also pay the $175.00 application fee. If the full amount is not paid by August 18, 2020, the Tenants will owe interest at 2% annually on the outstanding balance.
