What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant raised the issue of the Landlord collecting a rent deposit that exceeded one month's rent.
The ruling
The tenancy is terminated effective January 31, 2022, unless the Tenant pays $16,186 by January 31, 2022 to void the eviction order. The Tenant must pay $13,026.94 in rent arrears and compensation, less the rent deposit and interest owed to the Tenant. The Tenant must also pay $186 in application fees and $65.75 per day in compensation starting January 15, 2022 until the Tenant vacates.
