What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective August 5, 2020, which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective May 23, 2021. The Tenant must move out of the rental unit on or before May 23, 2021. The Landlord is authorized to offset $50.28 per day for compensation for the use of the unit starting April 29, 2021 to the date the Tenant moves out, and $186.00 for the cost of filing the application. If the Tenant wishes to void this order and continue the tenancy, the Tenant must pay $2,239.59 on or before April 30, 2021, or $3,768.96 on or before May 23, 2021.
