What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Tenants had paid rent late on multiple occasions prior to the application being filed.
The ruling
The Landlord's application for eviction of the Tenants is denied on the condition that the Tenants pay the full monthly rent on or before the first day of each month, commencing May 1, 2021 and for 8 months thereafter up to and including December 1, 2021. If the Tenants fail to comply with this condition, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 for an order terminating the tenancy and evicting the Tenants.
