What happened
Landlord applied to terminate tenancy and evict Tenants for failing to meet conditions specified in a previous consent order regarding smoke emanating from their unit. Tenants filed a motion to set aside the ex parte order issued in response to the Landlord's application.
The ruling
The Board granted the Tenants' motion to set aside the previous ex parte order. The Tenants are given one more opportunity to correct their smoking behavior. They must refrain from smoking in the rental unit, balcony, and common areas, and not allow smoke or odor to emanate from their unit that substantially interferes with others' enjoyment or the Landlord's rights.
