What happened

Landlord applied for an order to terminate the tenancy and evict the Tenants and for an order to have the Tenants pay compensation for damage they owe because the Tenants failed to meet a condition specified in the order issued by the Board on November 22, 2019 with respect to application TEL-05804-19.

The ruling

The Tenants' motion to set aside Order TEL-07887-19, issued on January 6, 2020, is granted. Order TEL-07887-19 is set aside and is of no force or effect. The Tenants shall pay to the Landlord the amount of $4,630.00 according to a new payment plan. If the Tenants fail to make payments under the new payment plan, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the 'Act'), within 30 days of the breach, without notice to the Tenants, for an order terminating the tenancy and evicting the Tenants.
