What happened

Tenants applied for an order determining that the Landlord collected or retained money illegally. The Tenants alleged they had an agreement with the Landlord to terminate the tenancy on December 6, 2020 and that the Landlord agreed to refund the rent paid for the remainder of December 2020, which the Landlord failed to do.

The ruling

The Tenants' application was dismissed. The Landlord did not improperly retain the last month's rent deposit, as the tenancy terminated on December 31, 2020 as agreed by the parties.
