What happened
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation.
The ruling
The tenancy is terminated effective October 19, 2021. The Tenant must move out by that date. The Tenant shall pay the Landlord $1,495.83, which represents compensation for the use of the unit from August 1, 2021 to October 8, 2021, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay the Landlord $42.74 per day for compensation for the use of the unit from October 9, 2021 to the date the Tenant moves out, as well as $201.00 for the cost of filing the application. If the Tenant does not pay the full amount by October 19, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
