What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
The ruling
The motion to set aside the eviction order is denied. However, the stay of the eviction order is lifted effective September 30, 2015 to allow the Tenant to find alternative housing. The Landlord is ordered to forward a copy of the decision to the Office of the Commissioner of Housing Equity (OCHE) for consideration.
