What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Tenant had paid $2,800 after the application was filed, but still owed $1,290.47 in rent arrears. The parties agreed to a prompt payment plan to resolve the persistent late payment issue.

The ruling

The tenancy is terminated effective September 23, 2014 unless the Tenant pays $1,460.47 to void the eviction order. If the unit is not vacated by September 23, 2014, the Landlord may file the order with the Sheriff to enforce the eviction. The Tenant may make a motion to set aside the arrears and termination portion of the order if they pay the required amount after September 24, 2014 but before the Sheriff gives vacant possession to the Landlord.
